Terms of Usage

These Terms of Usage (“Terms”) constitute a legally binding agreement between you (“User”) and Blitz Wallet LLC (“Blitz Wallet,” “we,” “us,” or “our”) governing your access to and use of the Blitz Wallet self-custodial Bitcoin, Lightning wallet application (the “App”). By installing, accessing, or using the App, you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree, you must discontinue all use of the App immediately.

Beta Disclaimer

The App, or portions thereof, may be released in beta or testing phases. Such releases are provided on an experimental basis and may contain defects, errors, or other issues. The User acknowledges and agrees that the use of beta functionality is entirely at their own risk, and Blitz Wallet disclaims all liability for any loss or damage arising from such use.

Scope of Supported Assets

The App currently supports Bitcoin and Spark tokens. Any attempt to send, receive, or store unsupported digital assets may result in permanent loss. Blitz Wallet does not warrant or represent that the App is compatible with any digital assets other than those explicitly designated as supported within the App.

Self-Custodial Nature of the App

The App is self-custodial. Users retain exclusive control of, and sole responsibility for, their private keys, recovery phrases, PIN codes, and other wallet credentials (collectively, “Wallet Credentials”). Blitz Wallet does not have access to, nor does it store, manage, or recover Wallet Credentials on behalf of Users.

User Responsibility: Users are solely responsible for safeguarding their Wallet Credentials. Loss, theft, or compromise of Wallet Credentials will result in the permanent and unrecoverable loss of digital assets.

Device Security: Users must maintain appropriate security of their devices, including operating systems, authentication methods, and software environments. Blitz Wallet is not responsible for unauthorized access to the App arising from inadequate device security.

Risk Acknowledgment

Users acknowledge and accept all risks associated with the use of the App, including but not limited to:

Permanent loss of access to funds due to loss of Wallet Credentials.

Cybersecurity risks, including but not limited to hacking, malware, or unauthorized access.

Market risks arising from the volatility of Bitcoin and other supported digital assets.

No Liability for Losses

To the maximum extent permitted by applicable law, Blitz Wallet shall not be liable for any damages, losses, or claims arising from, without limitation:

Errors or omissions by the User, including loss of Wallet Credentials.

Transactions directed to incorrect or unintended addresses.

Unauthorized access to the App or Wallet Credentials.

Software malfunctions, bugs, or failures within the App.

Any other use of or reliance upon the App.

Disclaimer of Warranties

The App is provided strictly on an “AS IS” and “AS AVAILABLE” basis without warranty of any kind, express or implied. Blitz Wallet expressly disclaims all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. Blitz Wallet makes no representation or warranty that the App will be uninterrupted, error-free, or secure.

Limitation of Liability

In no event shall Blitz Wallet, its affiliates, developers, or contributors be liable for any direct, indirect, incidental, special, consequential, punitive, or exemplary damages, including without limitation loss of funds, loss of profits, data breaches, or system failures, even if Blitz Wallet has been advised of the possibility of such damages. This limitation applies to all claims, whether arising under contract, tort, statute, or otherwise.

User Obligations

By using the App, Users agree to:

Comply with all applicable laws and regulations in their jurisdiction.

Implement reasonable measures to secure their devices and Wallet Credentials.

Acknowledge and accept the risks associated with the use of self-custodial wallets.

Third-Party Services

The App may provide access to or integrate with third-party services, applications, or websites (“Third-Party Services”). Blitz Wallet does not control, endorse, or assume responsibility for such services. Users acknowledge and agree that:

Third-Party Services are operated independently and subject to their own terms, conditions, and privacy policies.

Use of Third-Party Services is entirely at the User’s own risk.

Blitz Wallet disclaims all liability for losses, damages, or disputes arising from Third-Party Services.

Store Feature Disclaimer

The App may provide access to a store feature through which Users may purchase goods, services, or digital items using Bitcoin. All such transactions are conducted directly with independent third-party vendors. Blitz Wallet does not own, operate, or control these vendors and assumes no liability for the quality, delivery, accuracy, or legitimacy of products or services offered. All transactions conducted through the store feature are at the User’s sole risk.

Gift Card Feature Disclaimer

The App may permit Users to send or receive digital gift cards. Such gift cards are issued and fulfilled by third-party providers. Blitz Wallet acts solely as a reseller and does not issue, warrant, or guarantee the validity of gift cards.

Blitz Wallet may temporarily handle or display gift card claim codes in the course of facilitating transfers between Users. While reasonable measures are employed to secure such codes, Users acknowledge that, in the event of a compromise of Blitz Wallet’s reseller accounts or related systems, gift card codes could be exposed to unauthorized parties. By using this feature, Users expressly accept this risk.

Blitz Wallet shall not be liable for any losses, disputes, or damages related to gift card claim codes, including without limitation losses resulting from unauthorized redemption, third-party breaches, or User error in transmission.

Indemnification

Users agree to indemnify, defend, and hold harmless Blitz Wallet, its affiliates, developers, and contributors from and against any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys’ fees) arising out of or relating to the User’s breach of these Terms or misuse of the App.

Open Source Nature

The App is provided as open-source software. Users may inspect, modify, or distribute the code in accordance with the applicable open-source license. Notwithstanding, any use of the App, modified or otherwise, remains subject to these Terms.

Modifications to the Terms

Blitz Wallet reserves the right to amend, update, or modify these Terms at any time in its sole discretion. Any such modifications shall take effect upon posting the updated Terms with a revised “Last Updated” date. Continued use of the App following such posting shall constitute acceptance of the modified Terms.

Governing Law and Compliance

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising out of or relating to these Terms or the use of the App shall be subject to the exclusive jurisdiction of the courts of the United States.

Users are solely responsible for ensuring compliance with all applicable laws, regulations, and restrictions in their jurisdiction. Blitz Wallet makes no representation or warranty regarding the legality of the App in any specific jurisdiction.
