Transactions routed through or executed by third-party providers may be subject to delays, errors, or failures outside Blitz Wallet’s control. You understand and accept these risks, including potential loss of funds and network-level risks associated with blockchain operations.

Blitz Wallet does not provide investment, financial, tax, or legal advice. Nothing in the App or these Terms should be construed as a recommendation to buy, sell, or hold any Digital Assets. You should consult with qualified professionals before making financial decisions.

The App utilizes a proprietary secure Processing System that operates through a sandboxed WebView Component to handle computationally intensive wallet operations without impacting application performance.

To initialize your wallet, the App must perform a one-time, in-memory transmission of your Seed from your device's secure storage into the WebView Component during each wallet session. This transmission is necessary to enable wallet functionality including:

18. Dispute Resolution and Governing Law

18.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Michigan and applicable federal laws of the United States, without regard to conflict of law principles.

18.2 Agreement to Arbitrate

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

You and Blitz Wallet agree that any dispute, claim, or controversy arising out of or relating to these Terms, the App, or your use of the App (collectively, "Disputes") shall be resolved through binding individual arbitration rather than in court, except as specified in Section 18.7.

18.3 Informal Dispute Resolution Requirement

Before initiating arbitration, you agree to first contact us to attempt to resolve the Dispute informally.

We will attempt in good faith to resolve the Dispute informally. If we cannot resolve the Dispute within 90 days, either party may initiate arbitration.

This informal dispute resolution is a prerequisite to arbitration and must be completed before arbitration can begin.

18.4 Arbitration Rules and Procedures

If informal resolution fails, the Dispute shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules (the "AAA Rules"), as modified by these Terms.

18.9 Jurisdiction and Venue (If Arbitration Does Not Apply)

If the arbitration agreement is invalid, unenforceable, waived, or does not apply to a particular Dispute, or if you validly opt out, you agree that any judicial proceeding shall be brought exclusively in the state or federal courts located in Okland county Michigan, and you consent to the personal jurisdiction of these courts.

18.10 Jury Trial Waiver

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AND BLITZ WALLET WAIVE ANY RIGHT TO A JURY TRIAL for any Dispute, whether in arbitration or in court.

18.11 Time Limitation for Claims

You agree that any claim or cause of action arising out of or related to these Terms or the App must be filed within SIX (6) MONTHS after such claim or cause of action arose, or it will be permanently barred.

This six-month period begins when you knew or reasonably should have known of the facts giving rise to the claim.

18.12 Severability of Dispute Resolution Terms

If any portion of this Section 18 is found to be invalid or unenforceable, the remainder shall continue in full effect, except:

Notwithstanding Section 19 (Modifications to Terms), if Blitz Wallet makes any material changes to this arbitration agreement (other than a change to the contact information), you may reject the change by sending written notice within 30 days of the change to 230 W Mable Road Troy, MI 48084. Your rejection means you will arbitrate under the version of the arbitration agreement that existed when you first accepted these Terms (or, if applicable, the version you most recently accepted).

19. Modifications to Terms

Blitz Wallet reserves the right to modify, amend, or update these Terms at any time in our sole discretion. When we make changes, we will:

IMPORTANT: Because the App is self-custodial, termination does not affect your control over Digital Assets, provided you have properly secured your Wallet Credentials. However, you will no longer be able to access your funds through the Blitz Wallet App.

21. General Provisions

21.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Blitz Wallet regarding the App and supersede all prior agreements, understandings, and communications.

21.2 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

21.3 Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision. Any waiver must be in writing and signed by an authorized representative of Blitz Wallet.

21.4 Assignment

You may not assign, transfer, or delegate these Terms or your rights and obligations without our prior written consent. We may assign these Terms without restriction. Any attempted assignment in violation of this section is void.

21.5 No Partnership

Nothing in these Terms creates a partnership, joint venture, agency, or employment relationship between you and Blitz Wallet.

21.6 Force Majeure

Blitz Wallet is not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, natural disasters, war, terrorism, labor disputes, government actions, or internet/network failures.

21.7 Export Controls

You agree to comply with all applicable export and import laws and regulations. You represent that you are not located in, and will not use the App in, any country subject to U.S. embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. government list of prohibited or restricted parties.

21.8 Notices

Notices to you may be made via posting on our website. Notices to us should be sent to the contact information provided in Section 22.

21.9 Language

These Terms are prepared in English, and the English version shall prevail in the event of any conflict with translations.
